According to documents obtained by the outlet, Nicholas was allegedly driving erratically and as officers approached his vehicle, he “appeared nervous due to a visibly racing pulse on his neck and shaking hands.”

He then reportedly handed police a California ID with the name Kelton Shultz when asked to identify himself, who he claimed was his twin brother. Nicholas does have an identical twin brother, but his name is Kelly Donovan.

TMZ reports that upon searching the actor’s car, officers found a pill bottle with a medication prescribed to “Nicholas Bender” and another prescription for amphetamine salts was also found in the car which was prescribed to Kelton Schultz.

In 2015, Nicholas pleaded guilty to criminal mischief in New York after allegedly grabbing his girlfriend by the throat, stealing her car keys and smashing her cell phone.

He was reportedly arrested four times that year and entered rehab in June for substance abuse, depression and alcoholism.

Earlier this year, Nicholas shared his thoughts on allegations of misconduct against Buffy creator Joss Whedon.
