Derek Chauvin's Lawyer Is Asking for Jury's Guilty Verdict to Be Thrown Out in George Floyd Murder Trial

Derek Chauvin‘s attorney is attempting to overturn the jury’s decision in the George Floyd murder trial.

Attorney Eric Nelson filed legal documents on Tuesday (May 4) asking for the verdict to be thrown out due to errors pertaining to the jury and prosecution, TMZ reported.

The convicted murderer’s defense attorney claims he didn’t get a fair trial because the court disagreed with requests to sequester the jury and change venue.

The attorney also brought up Rep. Maxine Waters‘ encouragement of protestors to take to the streets and “get more confrontational” if the verdict wasn’t guilty, with some seeing that as incitement of violence. The legal docs claim her comments could have potentially swayed the jury.

Judge Cahill did not accept the request for a mistrial, but did say that the Representative’s remarks did open the door for an appeal of the verdict. However, the judge told the lawyer he had faith that the jurors followed orders not to look at the news and speak about the case with external parties.

Derek Chauvin‘s defense claims the jury should have been sequestered or at least warned to avoid all media, and therefore could have felt intimidated.

He was found guilty on all 3 counts, including second degree murder, last month. The maximum penalty for second degree unintentional murder is 40 years in prison.
